For those wishing to settle or remain in the UK indefinitely there are various routes to achieving this legally.  Permanent residence or Indefinite Leave to Remain is obtained by meeting the criteria for settlement in an immigration category.  Not all immigration categories will ultimately lead to settlement in the UK.  The time that should elapse before you can apply for settlement varies, depending on the category within which you are applying.  

If you are in the UK it is important to first establish your current immigration status.  Once Indefinite Leave to Remain is granted there are no time limits on the length of time you can stay in the UK and no restrictions on employment.  You can apply to become a British Citizen after you have obtained Indefinite Leave to Remain.

Indefinite Leave to Remain is now subject to passing the Knowledge of Language and Life in the UK test unless you fall within those excepted.

If you want to apply for Indefinite Leave to Remain in the UK, we will advise you of the requirements and take you through the application process involved, including how to evidence that you meet the necessary requirements.  We also advise you on whether any of your family members who are in the UK with you can also apply.

Long Residence

If you have been in the UK lawfully for ten or more years you may qualify for Indefinite Leave to Remain.

If you are in the UK unlawfully, for example, you arrived as a visitor and overstayed, and have been in the UK continuously for fourteen years or more you can apply for Indefinite Leave to Remain.  The fourteen years or more may consist of all unlawful or partly lawful and unlawful residence.
