Failing to obtain a HIP in the required circumstances is a Criminal Offence

 

 

As from 14th December 2007 all properties put on the market for sale require a Home Information Pack (HIP), save in limited circumstances. See “Who needs a HIP?

The Home Information Pack must include:

Index
Sale Statement,
An Energy Performance Certificate containing advise on how to reduce carbon emissions and save fuel costs,
Evidence of Title,
Replies to Local Search and Drainage Search,
Lease (if leasehold property)

 

and may also include the following:

 

Replies to Standard Preliminary Enquiries made of behalf of the Buyers,
Copies of any Planning, Listed Building and Building Regulations Consents and Approvals,
For new properties, copies of warranties and guarantees,
Any guarantees for work carried out on the property.

Unlike many other Pack Providers we include an “Official Local Authority Search” in preference to a “Personal Search”. Most Buyer’s Solicitors and Mortgage Lenders will not accept personal searches. A full search should enable your sale to proceed quicker once a buyer is found.

At present it is possible to market your property once the HIP has been commissioned although this is likely to change on 1st January 2009 when the Government advise that the HIP must be available before the property is marketed. (Although it is likely that there will remain in place provisions to include the required searches and leasehold information within 28 days of the pack being issued).
